Terms of Use
These terms are the agreement between you and OneMacStudio ("we", "us", "our"), a sole developer based in Tamil Nadu, India. OneMacStudio is the trading name of the individual developer named as the seller of DueTick on the App Store. These terms cover the DueTick iPhone app, its widgets and DueTick Pro.
By downloading or using DueTick, you agree to these terms. If you do not agree, please do not use the app. If you are under 18, or under the age of adulthood where you live, a parent or guardian must agree to these terms for you.
These terms add to Apple's standard licence for apps from the App Store (Apple's "Licensed Application End User License Agreement"), which you accept when you download any app. Where the two cover the same point differently, these terms apply between you and us, as far as the law allows.
We wrote these terms in plain English so that they can actually be read. The points in bold are the most important ones.
The short version.
- DueTick is your tool. It keeps track of the dates you give it and reminds you about them. We never see your deadlines, and we take no part in anything between you and the companies they are about.
- DueTick cannot act for you. It cannot cancel, renew, pay for or submit anything. Acting in time is always up to you.
- DueTick cannot check anything. It knows only what you type. If a date or amount you enter is wrong, what the app shows will be wrong too.
- Reminders depend on your iPhone and on iOS, and they can fail. Please do not rely on DueTick as your only way to remember anything important.
- Your deadlines live on your iPhone and in your own iCloud. We have no copy, so we cannot recover them.
- As far as the law allows, we are not responsible for any loss caused by a missed or late deadline, such as a charge, a fee, a penalty, lapsed cover or lost data.
- DueTick Pro is a one-time purchase through Apple. It is not a subscription. Apple handles payments and refunds.
1. What DueTick does
DueTick is a personal tool for keeping track of dates that cost you something if you miss them. With it you can:
- add deadlines of three types: a Subscription (it renews and charges you unless you cancel), something that Expires (it runs out unless you renew it), or a One-time deadline (it happens once);
- see the day to act by, and how much time is left;
- get reminders;
- record what you did (for example Cancelled, Keeping, Renewed, Not renewing or Done), and take it back for a few seconds afterwards;
- put a question off to a later day with Later;
- stop tracking a deadline and start it again later, or delete it;
- see your deadlines in home screen and lock screen widgets;
- export a copy of your deadlines as a spreadsheet file.
2. What DueTick does not do
Please read this section carefully.
- It does not act for you. It cannot cancel a subscription, renew a policy or document, make a payment, or submit anything. You must do that yourself, directly with the company or authority concerned.
- It does not connect to anything. It is not connected to your bank, your cards, your App Store subscriptions, your email or any company. It cannot see whether a charge was taken, a renewal went through, or a cancellation worked.
- It does not check what you enter. Every name, date, amount and choice comes from you. The app works out other dates, such as the next charge or the day to act by, from what you entered.
- It does not give advice. Nothing in DueTick is financial, legal, insurance, tax or other professional advice. The margins it keeps and the reminder options it offers are general settings, not a recommendation for your situation.
- It does not know the rules of the company you deal with. Companies set their own cancellation deadlines, billing times, notice periods and grace periods. They may charge earlier than you expect, bill in another time zone, or need notice well before the date. For example, App Store subscriptions renew automatically unless they are cancelled at least 24 hours before the end of the current period. Always check the company's own terms.
- It is not part of your agreements with anyone. We are not a party to any agreement between you and the companies, insurers, authorities or anyone else your deadlines are about. Any question or dispute about a charge, cancellation, renewal, refund or penalty is between you and them.
3. Your part
DueTick is your tool, and you stay in charge of your deadlines. It works best when it has the right facts, and some things only you can do. So, when you use DueTick, you agree that it is your responsibility to:
- enter correct dates, amounts and details, and keep them up to date;
- check important dates against the real source, such as your bill, policy, contract, account page or official notice;
- act in time, and leave yourself a margin before the real deadline;
- keep notifications allowed for DueTick, keep your iPhone switched on, charged and set to the correct date and time, and keep iOS reasonably up to date;
- open DueTick from time to time, so that it can keep your reminders scheduled (see "iOS holds only 64 reminders" in section 4);
- keep iCloud turned on if you want your deadlines synced, and kept safe when you change or lose your phone;
- keep another record, such as the company's own reminders or your calendar, for anything where missing the date would be serious, for example insurance, visa, passport, legal, tax or medical deadlines;
- keep your iPhone secure, because the names you enter can appear on your lock screen and in widgets;
- make sure you are allowed to enter any information about other people, such as a family member's policy.
Please do not use DueTick for anything where a missed or late reminder could put anyone's health or safety at risk, such as the timing of medicine.
4. Known limits
DueTick is carefully built, but some limits come from iOS, from Apple's services, or from how dates work. We would rather tell you now than have them surprise you later.
Reminders are not guaranteed. DueTick asks iOS to deliver reminders at the highest priority a normal app is allowed: from your act-by day, reminders are marked Time Sensitive, so that Focus does not hold them back. Even so, no app can guarantee delivery. A reminder can be late, or never arrive, if for example notifications for DueTick are off or limited, your iPhone is off or out of battery, your iPhone's date or time is wrong, a Focus or other setting hides it, or iOS does not let the app run. Reminders arrive at 9:00 in the morning, your iPhone's time, on the days you choose.
iOS holds only 64 reminders per app. DueTick keeps the nearest ones scheduled, and refreshes the list whenever you open the app, and sometimes in the background when iOS allows it. If you track many deadlines and do not open the app for a long time, later reminders may not be scheduled yet. When this could happen, the last scheduled reminder tells you to open DueTick.
Dates, not times. Deadlines are saved as calendar days, not times. Companies bill in their own time zone, which no app can look up, so a charge date is shown as a date only. That is why DueTick keeps a margin: cancel 2 days before a charge, renew 2 days before something expires, and finish 1 day before something is due. If something that expires, or a one-time deadline, is closer than that, its margin is shortened to fit the time left.
Calculated dates can differ from real ones. For a subscription, DueTick works out each next charge from the date and the repeat you entered. The company may charge on a different day, for example in a short month, after changing its billing date, or after a failed payment. If that happens, update the date in DueTick.
Travelling. A day you save, say 12 October, stays 12 October wherever you are. Your iPhone decides when that day starts and ends, using the time zone it is in now. If you travel across time zones close to a deadline, the countdown can be off by up to a day.
What happens if you do not answer. If you do not answer about a subscription, DueTick assumes it renewed and moves on to the next date, because it cannot know whether you cancelled. Something that expires, and a one-time deadline, stay on the screen as overdue until you answer.
Sync. Syncing between your devices uses your own iCloud account. It depends on Apple's service, your internet connection and your iCloud storage, and it can be delayed. If the same deadline is changed on two devices at about the same time, one change may replace the other.
Widgets show what the app last knew. Widgets are updated by the app. Something you add or change on another device reaches this iPhone's widgets after DueTick next runs on this iPhone.
Amounts are notes. An amount is just what you typed. DueTick does not convert currencies, check anything against your bank, or include taxes and fees. A message such as "That's ₹649 you kept" is simply the amount you entered.
Your iPhone's clock. Counts such as "3 days left" are worked out from your iPhone's date, time and time zone. If those are wrong, the counts are wrong.
Gregorian calendar. Dates are shown in the Gregorian calendar (January to December), even if your iPhone is set to another calendar.
English only. DueTick is currently available in English only.
Examples. The examples shown when you have no deadlines, such as "Netflix" or "Car insurance", are illustrations only. They are not real data, advice or endorsements.
Export is a copy, not a backup you can restore. The exported file is for your own records. DueTick cannot read it back in. It does not include reminder history, which reminders were delivered, your purchase, or deadlines you deleted.
Deleting is permanent. A deleted deadline cannot be recovered, by you or by us. "Stop tracking" keeps a deadline so that you can start it again.
5. Free use and DueTick Pro
- Free. DueTick is free to download. The free version lets you track up to 5 deadlines at a time. Deadlines you finished or stopped tracking do not count.
- Pro. DueTick Pro removes that limit. It is a one-time in-app purchase. It is not a subscription: it does not renew and does not expire. Pro changes how many deadlines you can add, and nothing else. It does not make reminders more reliable.
- Price. You pay the price shown in the App Store when you buy, in your local currency. Apple sets local prices and taxes, and takes the payment. Prices may change for future buyers.
- Apple handles payments, receipts and refunds, and any right to cancel a purchase that the law of your country gives you. Refund requests go to Apple, at reportaproblem.apple.com, and Apple decides them under its own policies. We cannot issue refunds ourselves.
- Restoring. Pro belongs to the Apple Account that bought it. Use Restore purchase in the app on another device, or after reinstalling.
- Approval. If a purchase needs approval (for example, with Ask to Buy), Pro unlocks once it is approved.
- Family Sharing. Pro is not available through Family Sharing.
- If a purchase is refunded or cancelled by Apple, Pro turns off. Nothing is deleted: every deadline you already have keeps working, including its reminders, but you cannot add more until you are back under the free limit.
- Nothing you have already added is ever taken away because you did or did not buy Pro.
6. Your content and privacy
What you enter in DueTick is yours. We claim no rights over it, and we cannot see it. The DueTick Privacy Policy explains how DueTick handles information. In short: no account, no server, no ads, no tracking and no analytics. Your deadlines stay on your iPhone and in your own iCloud.
Because we hold no copy of your data, we cannot restore lost or deleted deadlines. Keep iCloud on, and use Export if you want your own copy.
7. Your licence to use DueTick
We give you a personal, non-exclusive, non-transferable licence to use DueTick on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. DueTick may also be used by other accounts linked to the buyer through Family Sharing or volume purchasing, where these are available.
You must not:
- copy, change, or make works based on DueTick, except as the law allows;
- reverse engineer, decompile or disassemble it, except where the law allows this despite this term;
- rent, lease, lend, sell, redistribute or sublicense it;
- use it for anything unlawful, or in a way that could harm DueTick, us or anyone else.
DueTick, including its name, icon, design and code, belongs to us or our licensors and is protected by law. These terms do not give you any right to use our name or logo.
Company and product names shown in DueTick as examples, such as Netflix or Amazon, belong to their owners. DueTick is not connected with, endorsed by, or sponsored by them. Apple, iPhone, iCloud and App Store are trademarks of Apple Inc.
8. Changes to the app, and ending
We may update DueTick, change or remove features, or stop offering it. Some updates may be needed for the app to keep working, and future versions may need a newer version of iOS. We do not promise to provide updates, or to keep DueTick available for any particular time. If we stop offering DueTick, we will try to tell you in advance where we reasonably can. Export lets you keep a copy of your deadlines.
You can stop using DueTick at any time by deleting it. Your licence ends automatically if you break these terms. Sections 2, 3, 4, 6 and 9 to 17 continue to apply after it ends.
9. No warranty
DueTick is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement. In particular, we do not promise that DueTick will be accurate, reliable, available, uninterrupted or error-free, that reminders will arrive, that sync will work, or that data will not be lost.
Some countries do not allow some warranties to be excluded. Where that applies to you, these exclusions apply only as far as your local law allows.
10. Limitation of liability
To the fullest extent the law allows, and whether a claim is based on contract, tort (including negligence), breach of statutory duty or anything else:
- We are not liable for any loss or damage that results from a missed, late or wrong deadline, date, amount or reminder. This includes subscription or renewal charges, late fees, penalties, fines, interest, lost refunds or return windows, lost or lapsed insurance cover, lost applications, registrations, benefits or opportunities, and the cost of putting any of these right.
- We are not liable for lost or damaged data, or for any indirect, incidental, special, consequential or punitive loss, or loss of profit, income, savings or goodwill, even if we were told it could happen.
- Our total liability to you, for all claims about DueTick together, is limited to the amount you actually paid for DueTick Pro. If you have not bought Pro, you have paid us nothing, and to the extent the law allows, our total liability is nothing.
Nothing in these terms limits or excludes any liability that the law does not allow to be limited or excluded, for example liability for death or personal injury caused by negligence, liability for fraud, or your statutory rights as a consumer.
11. Your responsibility to us
To the extent the law allows, you agree to cover us against any claims by others, and any resulting losses and reasonable costs (including legal costs), that arise from your breach of these terms or your unlawful use of DueTick.
12. Things outside our control
We are not responsible for any failure or delay caused by things we cannot reasonably control, for example changes to or outages of iOS or Apple's services (including iCloud, notifications and the App Store), internet or power failures, faults in your device, natural disasters, or actions of governments.
13. Apple
DueTick is distributed through Apple's App Store. These terms are between you and us only. Apple is not a party to them, is not responsible for DueTick or its content, and has no obligation to provide any maintenance or support for it. Apple's standard licence also applies to your use of DueTick, and Apple and its subsidiaries are third-party beneficiaries of that licence. Purchases, payments and refunds are handled by Apple under its own terms. When you use DueTick, you must also follow any other terms that apply to you, such as Apple's Media Services Terms and Conditions and the iCloud Terms and Conditions.
14. Governing law and disputes
These terms are governed by the laws of India, and the courts of Tamil Nadu, India, have jurisdiction over any dispute about them. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts where you live if your local law gives you that right.
Before starting any formal claim, please email us first at hello@onemacstudio.in, so that we can try to put things right. Most problems can be solved that way, quickly.
15. Changes to these terms
We may change these terms, for example when DueTick or the law changes. We will update the date at the top, and mention significant changes in the app's release notes. If you keep using DueTick after a change, you accept the new terms. If you do not agree with them, please stop using DueTick and delete it.
16. General
- If part of these terms is invalid, that part is limited or removed only as much as needed, and the rest stays in force.
- If we do not enforce a right straight away, we have not given it up.
- Transfer. You may not transfer your rights under these terms. We may transfer ours to anyone who takes over DueTick, as long as that does not reduce your rights under these terms.
- Whole agreement. These terms, the DueTick Privacy Policy and Apple's standard licence are the whole agreement between you and us about DueTick.
- Language. These terms are written in English. If they are ever translated, the English version applies where the law allows.
